These General Terms and Conditions of Sale (“GTCS”) govern purchases of digital services offered to consumers through WIMIT by PROXIMA SYSTEMS SASU.
They notably cover, where offered:
General use of WIMIT is governed separately by the General Terms of Use (GTU).

Bon Points are virtual credits that may be used exclusively within WIMIT in accordance with the features and rules presented in the application.
They are neither currency, nor a payment instrument, nor remuneration.
They cannot be converted into cash or used outside WIMIT.
Some Bon Points may be obtained free of charge through use of and participation in WIMIT. Others may be acquired through paid packs.
Buying Bon Points is not necessarily required to use WIMIT: the service also relies on participation and reciprocity between users.
The applicable prices are those displayed at the time of the order.
Before confirming a purchase, the user is informed of the price and the content of the relevant offer.
Prices displayed by the Apple App Store or Google Play may depend in particular on the user’s country, currency, applicable taxes and the pricing rules of the relevant platform.
No purchase is made without the user’s confirmation through the payment process offered by the relevant platform.
The user selects the product or service they wish to acquire and confirms the purchase through the process offered on their device.
The order becomes final when payment has been validated by the relevant payment platform, subject to the rights granted to consumers by law.
The Bon Points or other rights purchased are then credited or activated on the WIMIT account associated with the purchase.
In the event of a technical delay, users are asked not to make multiple purchases and to contact PROXIMA SYSTEMS if the purchased product does not appear on their account.
Depending on the platform used, purchases may notably be processed by the Apple App Store, Google Play or any other payment method clearly presented at the time of the order.
When payment is made through a third-party platform, that platform processes the financial transaction under its own terms.
PROXIMA SYSTEMS does not receive the complete banking details used for these payments where they are processed directly by the payment provider.
After payment is confirmed, the purchased Bon Points are normally credited to the relevant WIMIT account.
They may then be used in accordance with the rules applicable to Bon Points and the relevant features.
Purchased Bon Points remain attached to the account on which the purchase was made and cannot be freely transferred to another user.
Bon Points already used in accordance with the normal operation of the service cannot be cancelled solely because the user subsequently changes their mind, without prejudice to mandatory rights provided by law.
When WIMIT offers a paid subscription, the essential characteristics of the offer, its price, duration, content and any automatic renewal are presented before subscription.
When a subscription is taken out through the Apple App Store or Google Play, it is managed from the user’s corresponding account in accordance with the mechanisms offered by the platform.
Deleting the WIMIT application or simply ceasing to use it does not necessarily cancel an ongoing subscription.
For an automatically renewing subscription, the user must use the cancellation mechanism provided by the relevant platform to prevent future renewals.
Cancellation takes effect under the conditions shown at subscription and those of the relevant platform.
Distance purchases are subject to the provisions of the French Consumer Code concerning the right of withdrawal.
As a general rule, consumers have a statutory withdrawal period where applicable.
However, for digital content supplied without a tangible medium where performance begins immediately, the law provides that the right of withdrawal may be lost when the legal conditions are met, notably where the consumer expressly requested or accepted that performance begin before the withdrawal period expires and acknowledged the loss of their right under the conditions provided by law.
The rules actually applicable to a purchase made through Apple or Google also depend on the purchase journey and the terms offered by the relevant platform.
Nothing in these GTCS may deprive consumers of a mandatory right provided by law.
Requests relating to a purchase made through the Apple App Store or Google Play may be submitted under the refund procedures of the relevant platform.
Where PROXIMA SYSTEMS is legally required to issue a refund or restitution, the applicable legal provisions prevail over any conflicting rule in these GTCS.
The virtual nature of Bon Points may therefore not be interpreted as removing consumers’ legal rights.
Paid digital services and content supplied by WIMIT benefit, where applicable, from the statutory guarantee of conformity for digital content and digital services provided by the French Consumer Code.
For a one-off supply, the professional is notably liable for lack of conformity existing at the time of supply and appearing within the applicable statutory period. For a continuously supplied service, this liability applies during the contractual supply period.
In the event of a lack of conformity, consumers benefit from the remedies provided by law, including bringing the service into conformity free of charge where the legal conditions are met.
These GTCS do not limit these statutory guarantees.
If payment has been validated without the purchased product being delivered, Bon Points have been credited incorrectly or another transaction-related anomaly occurs, the user may contact:
PROXIMA SYSTEMS may request the information reasonably necessary to identify the transaction and carry out the required checks.
In the event of a technical error resulting in an obviously incorrect or multiple credit of Bon Points without corresponding payment, PROXIMA SYSTEMS may correct the balance, provided that the user’s legitimate rights are not infringed.
PROXIMA SYSTEMS may change the prices of future purchases or update the offers available.
A price change does not retroactively change the price of a purchase already made.
For ongoing subscriptions, any price change is applied in accordance with legal rules and the procedures of the platform through which the subscription was taken out.
Deleting a WIMIT account may result in loss of access to Bon Points remaining attached to that account and to the associated features, subject to consumers’ mandatory rights.
Before deleting their account, users are advised to check any purchases or subscriptions that may still be active.
Deleting a WIMIT account does not necessarily cancel a subscription managed directly by Apple or Google.
PROXIMA SYSTEMS is responsible for properly performing its obligations under the conditions provided by applicable legislation.
However, it cannot be held liable for an inability to perform resulting notably from an external cause not attributable to it or from the user’s conduct, within the limits provided by law.
Nothing in these GTCS limits guarantees or liabilities that cannot legally be excluded.
Personal data processed in connection with purchases and payments is subject to the WIMIT Privacy Policy.
Depending on the payment method used, certain data is also processed directly by Apple, Google or other relevant providers in accordance with their own policies.
For any complaint relating to a WIMIT purchase, users may contact:
Users are advised to specify the email address of the relevant WIMIT account and, where available, the transaction reference.
In the event of a dispute that remains unresolved after a prior complaint to PROXIMA SYSTEMS, consumers may use the consumer mediator responsible for PROXIMA SYSTEMS free of charge, in accordance with the French Consumer Code. The professional must effectively allow consumers to use this option.
These GTCS are governed by French law, subject to any more protective mandatory provisions applicable to consumers.
The parties are invited to seek an amicable solution before bringing legal proceedings.
Consumers retain the right to bring proceedings before the competent courts in accordance with applicable legal rules.
These GTCS may be amended for future purchases, notably to reflect changes to WIMIT, its offers or applicable legislation.
The version applicable to a purchase is the version brought to the consumer’s attention at the time of the order, subject to mandatory legal provisions.
