These General Terms of Use (“GTU”) define the conditions for accessing and using WIMIT, a service published by PROXIMA SYSTEMS SASU.
WIMIT is a community platform that enables families belonging to the same trusted community, particularly one centred around a school, to organise and support one another in their daily lives.
WIMIT notably enables users to organise journeys for their children among themselves and may also offer community, family, event and educational support features.
Use of WIMIT implies acceptance of these GTU.
WIMIT provides a technical platform that enables users to connect, organise and support one another.
With regard to journeys organised between users, WIMIT:
Users arrange their journeys among themselves, in a private capacity, through the features provided by WIMIT.
Each user remains responsible for the commitments they make to other members and the journeys they agree to undertake.
Use of WIMIT is restricted to adults with the required legal capacity.
Certain features are specifically intended for parents, legal guardians or persons holding the necessary authorisations concerning the children involved.
Registration requires:
Each user is responsible for their account and for keeping their access credentials confidential.
Users undertake not to allow any unauthorised person to use their account.
Access to certain communities may be subject to a membership request, validation, access code or any other mechanism intended to preserve their controlled nature.
When a user enters a child’s details in WIMIT, they declare that they have the authority or permissions required to use the relevant features for that child.
The user is responsible for the accuracy of the information provided and for decisions concerning the child’s organisation, activities and journeys.
WIMIT does not replace holders of parental responsibility.
WIMIT is based in particular on a principle of mutual support and reciprocity among its members.
Certain features use internal credits called “Bon Points”.
Bon Points may notably be earned through participation in the community, in accordance with the rules presented in WIMIT.
Additional Bon Points may also be offered for purchase. The commercial terms applicable to these purchases are set out in the General Terms and Conditions of Sale.
Bon Points are a virtual unit specific to WIMIT. They:
No direct remuneration between users may be arranged using Bon Points.
Journeys offered or requested through WIMIT are based on users’ voluntary participation.
Depending on the features available, a user may notably offer a journey, respond to a request, accept or reject an offer, or cancel their participation.
WIMIT does not guarantee that a request will find a driver, that an offered journey will be accepted or that a confirmed journey can actually be completed.
In the event of cancellation, certain features may automatically make a request available to the community again in order to find another solution.
Any Bon Points committed may be credited back in accordance with the rules applicable to the relevant situation.
Any user undertaking a journey with one or more children notably agrees to:
The driver remains solely responsible for their driving and the vehicle they use.
WIMIT does not replace the checks and obligations legally incumbent on the driver.
The child’s parent or representative remains responsible for providing the information and instructions required for the child’s care.
A driver may refuse or discontinue care where behaviour creates a risk to the safety of the journey or those present, provided that the child is not placed in a dangerous situation.
WIMIT is not a party to disputes between users concerning a child’s behaviour or the conduct of a journey.
Certain journeys may be tracked using the location of the driver’s device.
This tracking is an information and coordination feature.
Its operation depends notably on the GPS signal, network connection, permissions granted on the device and the operation of third-party technical services.
The displayed location may therefore be delayed, inaccurate or temporarily unavailable.
WIMIT tracking does not replace vigilance and direct communication between the adults responsible for the child.
The persons concerned are responsible for actually verifying the collection and return of the child.
WIMIT may allow users to enter certain information about their identity, profile or vehicle to facilitate the organisation of journeys and strengthen trust within the community.
Depending on the available features, WIMIT may display certain statuses or verification indicators.
Unless expressly stated otherwise, these indicators do not constitute administrative or official certification.
Each user remains responsible for ensuring that the information they provide is accurate and up to date.
Schools may be referenced in WIMIT to identify or establish a community.
Unless expressly provided for under a partnership, merely referencing a school does not mean that it operates, administers, recommends or guarantees WIMIT.
Schools do not select drivers and are not responsible for journeys organised directly between users.
WIMIT may also be used in communities formed around associations, local authorities or other organisations where this option is offered.
WIMIT may offer features that enable users to publish information, organise events or birthdays and facilitate mutual support between members.
Users remain responsible for the content they publish or transmit.
Users undertake not to disseminate content that is illegal, fraudulent, threatening, harassing, discriminatory, hateful, infringes the rights of others or is manifestly inappropriate for the community concerned.
PROXIMA SYSTEMS may moderate, hide or remove content where this is necessary for the security or proper operation of WIMIT.
WIMIT may offer features using artificial intelligence, including WIMIT Boost, which is intended to help parents and children understand schoolwork.
Automatically generated analyses, explanations, exercises and other content are provided for support purposes.
They may contain errors or approximations.
They do not constitute an official school assessment or the opinion of a teacher or professional.
The user remains responsible for assessing and using the generated content.
WIMIT may send users communications required for the operation of the service, notably concerning the account, community, journeys, requests, events or security.
These communications may notably be sent by email or displayed in the application.
The conditions under which PROXIMA SYSTEMS collects, uses, retains and protects personal data are described in the WIMIT Privacy Policy.
That policy is separate from these GTU.
PROXIMA SYSTEMS implements the reasonable resources required for WIMIT to operate.
The service may nevertheless be temporarily interrupted or degraded, notably due to maintenance, a technical incident, an update or the unavailability of a third-party provider.
WIMIT’s features may evolve in order to improve, secure or adapt the service.
WIMIT provides tools that allow users to organise and interact but does not perform on their behalf the commitments they make to one another.
Each user remains responsible for their conduct, the information they provide and the decisions they make.
PROXIMA SYSTEMS cannot be held liable for a user’s acts or omissions or for consequences directly attributable to the user’s failure to comply with their obligations.
These provisions do not limit any liability that the law prohibits from being excluded or limited.
PROXIMA SYSTEMS may take action against an account, notably in the event of:
Depending on the circumstances, these measures may include a restriction, temporary suspension or deletion of the account.
Where circumstances permit, the user may be invited to remedy the situation before permanent deletion.
WIMIT, its trademark, interface, software and elements belonging to PROXIMA SYSTEMS are protected by applicable intellectual property rights.
Use of WIMIT does not grant any ownership rights over these elements.
Users remain responsible for the content they publish and declare that they have the necessary rights to use it in WIMIT.
PROXIMA SYSTEMS may amend these GTU, notably to reflect changes to the service or legislation.
Users will be informed of material amendments by an appropriate means.
Users may be required to accept the amended terms again where necessary.
These GTU are governed by French law, subject to mandatory provisions applicable to consumers.
In the event of a dispute, the user is invited to contact PROXIMA SYSTEMS beforehand in order to seek an amicable solution.
The statutory rules governing jurisdiction remain applicable.
